He is a business man and you dont normally give them that much power and control over investor's money without at least some controls. He may not be the benevelent person we all think he is. Hear hear. That would be a very bad idea.
However, if I understand correctly, when you do an IPO you publish a prospectus, which describes amongst others how the money raised through the IPO will be used. If you clearly state your plans up front, and people still invest in you, then it seems to me that you shouldn't lose any lawsuits that they subsequently may bring. Of course, I don't make the rules, so I'm not sure that that is actually the case, but it may give you some leeway. _________________ Say, can you feel the thunder in the air? I thought someone would have found the source before now - sigh.
Check the interview with Gwynn Shotwell on The Space Show date April 22 2010. The comment is right at the end of the show. She specifically states the above and qualifies it by saying the 'Elon will want to keep control' implying a less than 50% IPO. Please don't make comments that you can't back up. hm well if he's keeping 51% i guess it's still technically an IPO, but then all the reason i had for stating that it'd be crazy for them to do it don't apply since they're not turning over control. usually the company will offer enough stock that investors can override the CEO's decision making process.

You can IPO just 10% of the company, but that 10% still gets all sorts of statutory protections.

I doubt Elon will be juggling ownership or IPO around Space X considering he is in the middle of a divorce. And likely to loose a big piece of Tesla motors, which is considering an IPO.
